Terms of Service

1. Acceptance of Terms

By accessing and using DiffALL ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

These terms apply to all users of the Service, whether accessed locally or through a hosted deployment.

2. Description of Service

DiffALL is a tool for comparing media files — including images, videos, audio, and subtitles — and for checking the quality of a single image, video or audio file. For comparisons it provides metrics including SSIM, PSNR, MFCC similarity, Word Error Rate (WER), timing drift analysis, difference heatmaps, and frame-by-frame timeline analysis; for quality checks it provides measurements such as bitrate, sharpness, noise, compression, exposure, loudness and clipping, plus for photographs an estimate of how people would rate them, each banded from Excellent to Poor. That estimate is a statistical prediction from published human ratings, not a guarantee.

The AI check reports what a file declares about its origin (such as signed Content Credentials) and a model's estimate, from 3 to 97, of how likely the picture is to have been generated by AI. That number is a statistical estimate, not proof: it can be wrong in either direction, it rarely detects a small AI edit inside a real photograph, and it must not be used as the sole basis for accusing anyone, for moderation sanctions, or for legal, employment or academic decisions.

The Service is intended for research, development, and quality assurance purposes.

3. User Responsibilities

• You are solely responsible for the files you upload to this Service, whether to compare them or to check their quality.
• You must have the legal right to use and process any files you submit.
• You must not use the Service to process material that infringes third-party intellectual property rights, contains illegal content, or violates applicable laws.
• You agree not to attempt to reverse-engineer, overload, or interfere with the Service's operation.
• Uploaded files are processed temporarily and are automatically deleted from the server after processing. You should not upload files containing sensitive personal data.

4. Intellectual Property

The Service, including its source code, design, and analysis algorithms, is the intellectual property of its developer(s). You are granted a limited, non-exclusive, non-transferable right to use the Service for its intended purposes.

Files you upload remain your property. The Service does not claim any ownership over your uploaded content.

5. Accounts & Data

Comparing or checking files does not require an account. If you create one, you'll provide (or share via Google Sign-In) an email address, and we store your plan, credit balance, and a record of your comparisons and quality checks — not the files' content. Uploaded files themselves are processed temporarily and deleted after analysis, whether or not you're signed in.

Full details, including every third-party service involved (analytics, payments, error monitoring, email delivery), are in our Privacy Policy — that document, not this section, is authoritative on data practices.

6. Payment

Paid plans (the one-time credit pack and the Pro subscription) are billed through Lemon Squeezy, our merchant of record, who handles payment collection, card data, and applicable sales tax. Your purchase is also subject to Lemon Squeezy's own terms as merchant of record. A Pro subscription renews automatically each billing period until cancelled; you can cancel at any time by signing in and pressing Manage at the top of the site, or from the link in your Lemon Squeezy receipt email, and you keep access through the end of the period you already paid for.

7. Limitation of Liability

The Service is provided "as is" without any warranty of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that results will meet your specific requirements.

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Metric results (SSIM, PSNR, MFCC, etc.) are provided for informational purposes only and should not be used as the sole basis for critical technical or business decisions.

8. Governing Law

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Any dispute arising from use of this Service shall be brought exclusively in the competent courts of Israel.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

9. Refunds & Credits

All purchases of credits or a Pro subscription are final. We do not offer refunds except where required by applicable law. If you believe you were charged in error, or a technical failure prevented you from using purchased credits, contact lucynight.studio@gmail.com within 14 days of the charge and we will review your case individually.

Separately — and automatically, with no request needed — a credit is refunded to your account whenever a comparison or quality check you paid for fails to complete (a server error, an unreadable file, or similar). That is a technical safeguard, not a discretionary refund, and this section does not affect it.

Credits are non-transferable and have no monetary value outside of this Service.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be reflected by an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
